Developer Contributions & Financial Obligations - Section 106 Strategy Hinckley and Bosworth Borough Council recognises the contribution that new development can make to advancing the economy of the district and increasing opportunities to provide new homes, jobs, leisure and shopping opportunities. Whilst valuing these benefits, it is also recognised that new development can place additional pressures on the infrastructure of the area such as play and open space facilities, community facilities, education, public transport and roads. The council considers that new development should make adequate provision for the recreation, education, community and infrastructure needs of new residents and employees. Where development impacts are identified, planning obligations (legal agreements under Section 106 of the Town and Country Planning Act) will be used to ensure that on site provision or financial contributions are made to mitigate the impact on local infrastructure in order to make a scheme acceptable. In addition, the Borough Council also adopted Supplementary Planning Guidance relating to the provision of Play and Open Space in October 2008. Please find below details of the financial contributions acquired from Section 106 Agreements and open space contributions. All proposed contributions should be submitted as a draft Heads of Terms or as a Draft Legal Agreement using one of our standard templates available from: www.hinckley-bosworth.gov.uk/legal, with a copy of the pre-application responses which have been obtained from the relevant authorities.
Policy IMP1 of the Hinckley and Bosworth Local Plan requires developers to make contributions towards the provision of infrastructure and facilities to serve the development commensurate with the scale and nature of the development proposed. Policies REC2 and REC3 of the Local Plan, Policy 19 of the Core Strategy require contributions towards public play and open space The Council’s SPD on Play Space provides additional information on the calculation of the contributions and your calculations should be submitted with the Heads of Terms. Policies RES2, RES3 and RES4 of the Local Plan, Policy 15 of the Core Strategy require contributions towards affordable housing. The Council’s SPD on affordable housing provides additional information on the Council’s Requirements.
