Planning regulations for indoor markets

Please read this information before applying for a licence for an indoor market of any type.

A regular indoor market of any type will require change of use planning permission. Outdoor markets or one-off indoor markets in a suitable building with sufficient parking, will not generally need planning permission.

Indoor markets

Planning legislation states that the temporary use of land for a market which is held in a building or within the curtilage (the immediate surrounding land, including closely associated buildings and structures) of a building requires planning permission. This is established within The Town and Country Planning (General Permitted Development) (England) Order 2015 (As Amended). If an application relates to a one-off temporary market to be held within a building or the curtilage of a building, a change of use planning application for this one-off event is not required providing that the hours are reasonable and there is sufficient parking (such as a school or community building).

However, if our Planning Service are of the opinion that the proposed location/hours for a one-off temporary market event within a building or the curtilage of a building would be inappropriate (such as a small residential property) the Planning Service will respond to the consultation to state that a change of use planning application will be required.

If an application relates to temporary market events within a building or the curtilage of a building to be held frequently rather than a one-off, the Planning Service will respond to the consultation to state that a change of use planning application will be required.

Outdoor markets

Planning legislation states that the temporary use of land for a market which is held outside the curtilage of a building is acceptable for up to 14 days in a calendar year.
